It is our policy to respond to all valid claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) of 1998 and applicable international copyright laws.

1. Reporting Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of a copyright owner, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement on our Site, please submit a formal DMCA takedown notice to our designated copyright agent using the contact information provided below.

2. Required Information for a DMCA Takedown Notice

To be effective under the DMCA, your notice must be in writing and must include all of the following information:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered in a single notification, provide a representative list of those works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and where it is located on the Site (please provide the specific URL or URLs of the page(s) in question).
  3. Contact information: Your full name, mailing address, telephone number, and email address.
  4. Statement of good faith: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy: A statement made under penalty of perjury that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Signature: A physical or electronic signature of the person authorized to act on behalf of the copyright owner.

Notices that do not comply with all of these requirements may not receive a response. Incomplete or invalid notices will not be acted upon.

3. Where to Submit Your Notice

We will acknowledge receipt of your notice and aim to respond within 5–7 business days.

4. Our Response to Valid DMCA Notices

Upon receipt of a valid and complete DMCA takedown notice, BioPedia World will:

  • Promptly investigate the claim and review the reported content
  • Remove or disable access to the allegedly infringing content if found to be valid
  • Notify the person who posted the content that it has been removed or disabled
  • Take appropriate action under our repeat infringer policy where applicable

5. Counter-Notification

If you believe that content on our Site was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. A valid counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the content that was removed and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed by mistake or misidentification
  4. Your name, address, telephone number, and email address
  5. A statement that you consent to the jurisdiction of the relevant federal court and that you will accept service of process from the person who filed the original DMCA notice

Upon receipt of a valid counter-notification, we may restore the removed content within 10–14 business days unless the copyright owner initiates legal action.

6. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. BioPedia World reserves the right to restrict, suspend, or terminate access to the Site to any user who repeatedly infringes upon the copyrights of others.

7. Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability. Please ensure that your notice is accurate and made in good faith.

8. Fair Use Notice

BioPedia World may, in certain cases, reference, quote, or reproduce limited portions of third-party content under the fair use doctrine for purposes of criticism, commentary, news reporting, education, or research. If you believe that a particular use of your content does not qualify as fair use, please contact us so we can review the matter.
